That's because most counties and municipalities report old tickets to a central database, called the Texas Onmibase. By "Old tickets," we are referring to class C tickets that have either never never been handled in court, went to warrant, or were never fully paid off after handling them in court. These unresolved Class C Tickets get entered into the DPS Omnibase, and remain there until the court sends a notice that the case and all requires fees have been satisfied.
Class C tickets can range from Failure to Appear, Speeding, No Insurance Tickets, DWLI, and even other Class C non-driving offenses such asUnderage Drinking and Alcohol cases.If a person has never been to court, and never paid the tickets, then an attorney can help get the warrant recalled, and try to resolve the case (hopefully with a dismissal). At that point, the court will send a notice to DPS to clear the Omni hold. There is typically a $70 OMNI and Warrant fee that must be paid prior to removal, independent of the court fees. Depending on the situation, this fee might only be $30 or $40. In rare situations a Judge can waive this, but most Judges will require the OMNI/Warrant fees to be paid, especially if the cases are being dismissed.
One of the best defenses is to make sure the prosecuting agency has actually 'filed' the case, and followed the procedures to preserve the Statute of Limitations. If not, then the tickets should be dismissed -- but the Omni and Warrant Fees above will still be required.
